Politics and Human Rights of HIV+ and AIDS

In a stunning case, an Indian Court has ruled that marriage is “anathema without sex.” Specifically, the court has held that a person whose spouse is found to be HIV positive is justified in seeking a divorce. It ruled that a “happy marriage” is not a possibility in instances when married couples cannot be physically together because of a communicable disease. ¬†According to U.S. Government numbers the number of individuals with AIDS is expected to top 20-25 million by the year 2010. One of the biggest challenges confronting health care workers is the cultural resistance to discussions on sex and sexual practices in India. Interestingly, India is also one of the few places in the world, where there are functional marriage agencies that seek to match HIV Positive couples who have been ostracized by rest of the community.
